This Data Privacy Agreement (“Data Privacy Agreement”) is an agreement between
the User (a “User”) and RF-Works, Inc. 1221 Worthington Woods Blvd, Columbus,
OH 43085 (“RF-Works”) about the User’s usage of RF-Works’ website (https://rf-
works.com/), and files, and services provided on, linked to, downloaded from, or
otherwise made available from such website (collectively the “Website”).

If User does not agree with the Agreements, then User should not access
or use the Website or any of RF-Works’ Services.

SECTION 1 – INTRODUCTION

This Data Privacy Policy covers the information RF-Works collects about the User
when the User uses the Website or RF-Works’ other products or services, or
otherwise interacts with RF-Works (for example, by sending an email).  The
Website offers a wide range of products, which together other services offered by or
through the Websites may be referred to as “Services”.

This policy also explains the User’s choices about how RF-Works uses information
about the User.  The User’s choices include how to object to certain uses of
information about the User and how the User can access and update certain

information.  If User does not agree with the Agreements, then User should
not access or use the Website or any of RF-Works’ Services.

Where RF-Works provides the Services under contract with an organization (for
example the User’s employer) that organization controls the information processed
by the Services. For more information, please see Notice to End Users below.

This Data Privacy Agreement does not control, and RF-Works shall bear no
responsibility for, the privacy, information or other practices of any third party,
including any third-party service provider or vendor, and any third-party operating
software applications or websites to which the Website contains a link.

This Data Privacy Agreement incorporates by reference the Website Usage
Agreement by and between RF-Works and User. Certain terms not defined in this
Website Usage Agreement are defined in the Data Access Agreement.

SECTION 2 – PERSONAL INFORMATION

Personal information (“Personal Information”) is data that identifies a User. RF-
Works and its affiliates may collect personal information from the User, including
User’s:
– Name
– Mailing address (including billing and shipping addresses)
– Telephone number
– Email address
– Credit Card or debit card number
– Type of browser User uses
– Files User requests
– Operating system User uses
– IP address from the pages User visited
– URLs of the pages that User came from and goes to
– Geographic location from where User requests information
– Information collected through cookies, pixel tags and other technologies

– Demographic information
– Aggregated information

SECTION 3 – USE OF PERSONAL INFORMATION

RF-Works will not use or disclose Personal Information, unless it is required or
permitted under federal and state laws that apply to RF-Works or to support or
improve the services provided by the Website, as well as RF-Works’ business
functions, whether online or offline.

RF-Works has the unlimited right to disclose Personal Information to government
officials or others if legally required to do so. In addition, certain laws allow or
require RF-Works to disclose Personal Information in emergency situations or to
protect RF-Works’ rights.

RF-Works may disclose Personal Information to RF-Works’ agents or business
associates, and to third-party service providers that may use Personal Information
to: (i) respond to the User’s inquiries and fulfill the User’s requests,
Send the User administrative information, including information regarding any
solutions or tools provided on the Website and changes to this Agreement’s terms,
conditions and policies (though User acknowledges that notification of such changes
is effective upon publication on the Website); (ii) personalize the User’s experience
by presenting products or offers selected for User, and (iii) send the User
communications related to products or downloads, and related offers and
promotions.

In addition, RF-Works may use Personal Information to create aggregated,
anonymized data, which may be used to tailor the Website or other RD-Works
products to the User’s interests, develop new features, and monitor the usage of
the Website. RF-Works may perform analyses of this data and disclose the results
as permitted by applicable law.

Excepting personally identifiable information, RF-Works reserves the right to use
and disclose any other information for any purpose. In the event that RF-Works
matches other information with User’s legally protected health information, RF-
Works will treat the combination as personal protected health information as long
as the information is combined and is required by applicable law.

RF-Works may be required to share information User provides RF-Works through
the Website and in other limited circumstances in which RF-Works may share or
transfer the information User provides through the Website, for example, to
respond to judicial process, to comply with state, federal, or local laws, to protect
the security or integrity of RF-Works’ databases or Website, to take precautions
against liability, in the event of a corporate reorganization, to the extent required
by law, or to provide information to law enforcement agencies.

RF-Works may disclose, transfer or sell personal information collected through its
website as an asset of the company in conjunction with due diligence for or
completion of a merger, reorganization or sale to a third party of RF-Works or a
material portion of its assets.

SECTION 4 – COOKIES

This Section 4 incorporates by reference Section 11 of the Website Usage
Agreement.

RF-Works uses what is known as cookies to improve User’s experience on RF-
Works’ site. Cookies are small pieces of data placed in the User’s computer's
browser to store the User’s preferences.

Cookies themselves do not generate personal information about the User. RF-Works
does not attempt to link cookie data to the User’s personal information. RF-Works
uses cookies only to make the User’s experience on RF-Works’ website more
enjoyable.

If the User chooses not to accept cookies, the User may be unable to take full
advantage of RF-Works’ website's features.

SECTION 5 – USE OF INFORMATION

SECTION 5.1 – What INFORMATION RF-WORKS COLLECTS

RF-Works collects information about Users when Users provide it to RF-Works,
when Users use RF-Works’ Services, and when other sources provide it to RF-
Works, as further described below.

Some of RF-Works’ products, tools and services may allow the User to download or
personalize the content received from RF-Works. For these products and services,
RF-Works may record information about the User’s downloads and preferences,
along with any information the User provides about himself/herself/itself. If the
product, tool or service requires the User to log in to an RF-Works account, this
information will be associated with the User’s RF-Works account.

SECTION 5.2 – INFORMATION PROVIDED BY USERS TO RF-WORKS

RF-Works collects information about Users when Users input it into the Services or
otherwise provide it directly to RF-Works.

SECTION 5.3 – ACCOUNT INFORMATION

 RF-Works collects information about Users when Users register for an account,
create or modify their profiles, set preferences, sign-up for or make purchases
through the Services. For example, the User provides contact information and, in
some cases, billing information when the User registers for the Services. RF-Works
keep track of the User’s preferences when he/she selects settings within the
Services.

SECTION 5.4 – WEBSITE PROVIDED INFORMATION

The Services include RF-Works websites owned or operated by RF-Works. RF-Works
collects other content that the User submits to these websites, which includes social
media or social networking websites operated by RF-Works. For example, the User

provides content to RF-Works when the User provides feedback or participates in
any interactive features, surveys, contests, promotions, sweepstakes, activities or
events.

SECTION 5.5 – INFORMATION PROVIDED FOR CUSTOMER SUPPORT

The Services include RF-Works’ customer support, where the User may choose to
submit information regarding a problem he/she is experiencing with a Service.
Whether the User designates himself/herself as a technical contact, opens a support
ticket, speaks to one of RF-Works’ representatives directly or otherwise engages
with RF-Works’ support team, the User will be asked to provide contact information,
a summary of the problem the User is experiencing, and any other documentation,
screenshots or information that would be helpful in resolving the issue.

SECTION 5.6 – PAYMENT INFORMATION

RF-Works collects certain payment and billing information when the User registers
for certain paid Services.  For example, RF-Works asks the User to designate a
billing representative, including name and contact information, upon registration.
The User might also provide payment information, such as payment card details,
which RF-Works collects via secure payment processing services.

SECTION 5.7 – INFORMATION COLLECTED FROM SUPPORT SERVICES

RF-Works collects information about Users when the User interacts with RF-Works
electronically, including browsing RF-Works’ websites and taking certain actions
when licensing RF-Works’ products or requesting support services.

SECTION 5.8 – WEBSITE ANALYTICS DATA

RF-Works keeps track of certain information about the User when the User visits
and interacts with RF-Works. This information includes the licensed products and
features User uses; the links User clicks e.g., size and filenames of attachments the
User downloads; frequently used search terms; and the information User provides
during support requests.

SECTION 5.9 – DEVICE AND CONNECTION INFORMATION

RF-Works also collects information through User’s device about User’s operating
system, browser type, IP address, URLs of referring/exit pages, device identifiers,
and other data. RF-Works may use the User’s IP address or country preference in
order to approximate the User’s location to provide the User with a better Service
experience.  How much of this information RF-Works collects depends on the type
and settings of the device the User uses to access the Services.  Server and data
center Service administrators can disable collection of this information via the
administrator settings or prevent this information from being shared with RF-Works
by blocking transmission at the local network level.

SECTION 5.10 – COOKIES

RF-Works and RF-Works’ third-party partners, such as RF-Works’ advertising and
analytics partners, use cookies and other tracking technologies (e.g., web beacons,
device identifiers and pixels) to provide functionality and to recognize the User
across different Services and devices. For more information, please see Section [X]
of the Website Usage Agreement, or contact RF-Works for information on how to
control or opt out of these cookies and tracking technologies (or include opt-out
info here).

SECTION 5.11 – INFORMATION FROM OTHER SOURCES

RF-Works receives information about the User from other Service users, from third-
party services, from RF-Works’ related companies, and from RF-Works’ business
and channel partners.

SECTION 5.12 – INFORMATION PROVIDED BY OTHER USERS

Other users of RF-Works’ Services may provide information about the User when
the User submits content through the Services.  For example, an administrator may
provide the User’s contact information when it designates the User as the billing or
technical contact on the User’s company’s account.

SECTION 5.13 – RF-WORKS PARTNERS

RF-Works work with a global network of partners who provide consulting,
implementation, training and other services around RF-Works’ products.  Some of
these partners also help RF-Works to market and promote its products, generate
leads for RF-Works, and resell RF-Works’ products.  RF-Works receives information
from these partners, such as billing information, billing and technical contact
information, company name, what RF-Works products the User has purchased or
may be interested in, evaluation information the User has provided, what events
the User has attended, and what country the User is in.

RF-Works receives information about the User and the User’s activities from third-
party partners, such as advertising and market research partners that provide RF-
Works with information about the User’s interest in and engagement with, RF-
Works’ Services and online advertisements.

SECTION 6 – USE OF COLLECTED INFORMATION

How RF-Works uses the information it collects depends in part on which Services
the User uses, how he/she uses them, and any preferences the User has
communicated to RF-Works.  Below are the specific purposes for which RF-Works
uses the information it collect about the User.

SECTION 6.1 – PROVIDION OF PRODUCTS AND SERVICES; SUPPORT AND
PERSONALIZE USER EXPERIENCE

RF-Works uses information about the User for various purposes, including to
process transactions with the User, authenticate the User upon log-in, provide
customer support, and operate and maintain the products.

SECTION 6.2 – COMMUNICATING WITH USER

RF-Works uses the User’s contact information to send transactional communications
via email and if applicable within the product licensing portal, including confirming
the User’s purchases, reminding the User of subscription expirations, responding to
the User’s comments, questions and requests, providing customer support, and
sending the User technical notices, updates, security alerts, and administrative

messages.  RF-Works sends the User email notifications when the User or others
interact with the User, for example, when the User is @mentioned on a page or
ticket or when a task is assigned to the User. RF-Works also provides tailored
communications based on the User’s activity and interactions with RF-Works.  To
the extent that these communications are part of the Product, the User cannot opt
out of them.  If an opt-out is available, the User will find that option within the
communication itself or in his or her account settings.

SECTION 6.3 – MARKETING

RF-Works uses the User’s contact information to send promotional communications
that may be of specific interest to the User, including by email and by displaying
RF-Works’ ads on other companies’ websites and applications, as well as on
platforms like Facebook and Google.  These communications are aimed at driving
engagement and maximizing what the User gets out of RF-Works’ products,
including information about new features, survey requests, newsletters, and events
RF-Works thinks may be of interest to the User.  RF-Works also communicates with
the User about new product offers, promotions and contests.  The User can control
whether he/she receives these communications as described below under “Opt-out
of communications.”

SECTION 6.4 – CUSTOMER SUPPORT

RF-Works uses the User’s information to resolve technical issues the User
encounters, to respond to the User’s requests for assistance, to analyze crash
information, and to repair and improve the Services.

SECTION 6.5 – SAFETY AND SECURITY

RF-Works uses information about the User and the User’s Product use to verify
accounts and activity, to monitor suspicious or fraudulent activity and to identify
violations of Service policies.

SECTION 6.6 – REQUIRED OR PERMITTED BY APPLICABLE LAW

Where required by law or where RF-Works believes it is necessary to protect its
legal rights, interests and the interests of others, RF-Works uses information about
the User in connection with legal claims, compliance, regulatory, and audit
functions, and disclosures in connection with the acquisition, merger or sale of a
business.

SECTION 7 – GDPR COMPLIANCE

SECTION 7.1 – INTRODUCTION

If the User is an individual in the European Economic Area (EEA), RF-Works collects
and processes information pursuant to this Section 7 about the User only where RF-
Works has legal bases for doing so under applicable EU laws.  The legal bases
depend on the products or services the User uses and how the User uses the
products or services. This means RF-Works collects and uses the User’s information
only where:
– RF-Works needs it to provide the User the Products or Services, including to
operate the Products or Services, provide customer support and personalized
features and to protect the safety and security of the Products or Services;
– It satisfies a legitimate interest (which is not overridden by the User’s data
protection interests), such as for research and development, to market and
promote the Products or Services and to protect RF-Works’ legal rights and
interests;
– The User gives RF-Works consent to do so for a specific purpose; or
– RF-Works needs to process the User’s data to comply with a legal obligation.

SECTION 7.2 – INDIVIDUAL RIGHTS

An individual’s principal rights under data protection law are:
(a)    the right to access;
(b)    the right to rectification;
(c)    the right to erasure;
(d)    the right to restrict processing;
(e)    the right to object to processing;
(f)    the right to data portability;

(g)    the right to complain to a supervisory authority; and
(h)    the right to withdraw consent.

If the User has consented to RF-Works’ use of information about the User for a
specific purpose, the User has the right to change his/her mind at any time, but this
will not affect any processing that has already taken place.  Where RF-Works is
using the User’s information because RF-Works or a third party (e.g. the User’s
employer) has a legitimate interest to do so, the User has the right to object to that
use, although, in some cases, this may mean no longer using the Services.

If the User has consented to RF-Works’ use of information about the User for a
specific purpose, the User has the right to change his/her mind at any time, but this
will not affect any processing that has already taken place.  Where RF-Works is
using the User’s information because RF-Works or a third party (e.g. the User’s
employer) has a legitimate interest to do so, the User has the right to object to that
use though, in some cases, this may mean no longer using the Services.

SECTION 7.3 – INFORMATION STORAGE AND SECURITY

RF-Works uses data hosting service providers in various jurisdictions to host the
information it collects, and RF-Works employs certain measures to secure the
User’s data.

SECTION 7.3.1 – RETENTION LENGTH
How long RF-Works keeps information it collects about the User depends on the
type of information, as described in further detail below.  After such time, RF-Works
will either delete or anonymize User information or, if this is not possible (for
example, because the information has been stored in backup archives), then RF-
Works will securely store User information and isolate it from any further use until
deletion is possible.

SECTION 7.3.2 – ACCOUNT INFORMATION: RF-Works retains User account
information for as long as the User’s account is active and a reasonable period

thereafter in case the User decides to re-activate the Services.  RF-Works also
retains some User information as necessary to comply with RF-Works’ legal
obligations, to resolve disputes, to enforce RF-Works’ agreements, to support
business operations, and to continue to develop and improve RF-Works’ Services.
Where RF-Works retains information for Service improvement and development, it
take steps to eliminate information that directly identifies the User, and RF-Works
only uses the information to uncover collective insights about the use of RF-Works’
Services, not to specifically analyze personal characteristics about the User.

SECTION 7.3.3 – INFORMATION SHARED BY USER ON BEHALF OF USER’S
ORGANIZATION: If the User’s account is deactivated or disabled, some User
information and the content provided will remain in order to allow the User’s team
members or other users to make full use of the Services.

SECTION 7.3.4 – MANAGED ACCOUNTS: If the Products or Services are made
available to the User through an organization (e.g., User’s employer), RF-Works
retains information as long as required by the administrator of that account.

SECTION 7.3.5 – MARKETING INFORMATION: If the User has not opted out of
receiving marketing emails from RF-Works, then RF-Works retains information
about User’s marketing preferences for a reasonable period of time from the date
the User last expressed interest in RF-Works’ Products or Services.  RF-Works
retains information derived from cookies and other tracking technologies for a
reasonable period of time from the date such information was created.

SECTION 7.3.6 – USER’S ACCESS AND CONTROL OF INFORMATION
The User has certain choices available when it comes to his/her information. Below
is a summary of those choices, how to exercise them and any limitations.

SECTION 7.3.6.1 – User Choices: 
The User has the right to request a copy of the User’s information, to object to RF-
Works’ use of User’s information (including for marketing purposes), to request the
deletion or restriction of User’s information, or to request User information in a
structured, electronic format.  Below, RF-Works describes the tools and processes
for making these requests.

The User’s requests and choices may be limited in certain cases: for example, if
fulfilling the User’s request would reveal information about another person, or if the
User asks to delete information which RF-Works or the User’s administrator are
permitted by law or have compelling legitimate interests to keep.  Where the User
has asked RF-Works to share data with third parties, for example, by installing
third-party apps, the User will need to contact those third-party service providers
directly to have the User’s information deleted or otherwise restricted.  If the User
has unresolved concerns, the User may have the right to complain to a data
protection authority in the country where the User lives, where the User works, or
where the User feels his or her rights were infringed.

SECTION 7.3.6.2– Access and update information: Some of RF-Works’
Products or Services and related documentation give the User the ability to access
and update certain information about himself/herself from within the Service. For
example, the User can access his/her profile information from the User’s account
and search for content containing information about himself/herself using key word
searches in the Service.  The User can update User profile information within User
profile settings and modify content that contains information about the User using
the editing tools associated with that content.

SECTION 7.3.6.3 – Deactivate User Account:  If the User no longer wishes to
use these Products or Services, the User or the User’s administrator may be able to
deactivate User Services within such an account. If the User can deactivate his/her
own account, that setting is available to the User in account settings. Otherwise,
please contact the administrator. If the User is an administrator is unable to
deactivate an account through administrator settings, please contact RF-Works
support. Be aware that deactivating the User account does not delete User
information; User information remains visible to other Service users based on the

User’s past participation within the Services.  For more information on how to
delete User information, see below.

SECTION 7.3.6.4 – Request that RF-Works stop using the User
information:  In some cases, the User may ask RF-Works to stop accessing,
storing, using and otherwise processing the User information where the User
believes RF-Works doesn’t have the appropriate rights to do so.  For example, if the
User believes a Services account was created for the User without permission or the
User is no longer an active user, the User can request that RF-Works delete the
User account as provided in this policy.  Where the User gave RF-Works consent to
use the User information for a limited purpose, the User can contact RF-Works to
withdraw that consent, but this will not affect any processing that has already taken
place at the time. The User can also opt out of RF-Works’ use of the User’s
information for marketing purposes by contacting RF-Works, as provided
below.  When such a request is made, RF-Works may need time to investigate and
facilitate the request.  If there is delay or dispute as to whether RF-Works has the
right to continue using the User’s information, RF-Works will restrict any further use
of that User’s information until the request is honored or the dispute is resolved,
provided the User’s administrator does not object (where applicable).  If the User
objects to information about the User being shared with a third-party app, please
disable the app or contact the User’s administrator to do so.

SECTION 7.3.6.5 – Opt out of communications: The User may opt out of
receiving promotional communications from RF-Works by using the unsubscribe link
within each email, or by contacting RF-Works as provided below to have the User’s
contact information removed from RF-Works’ promotional email list or registration
database.  Even after the User opts out from receiving promotional messages from
RF Works, the User will continue to receive transactional messages from RF-Works
regarding RF-Works’ Some of RF-Works’ Products or Services. The User can opt out
of some notification messages in the User’s account settings.

SECTION 7.3.6.7 – Send “Do Not Track” Signals: Some browsers have
incorporated “Do Not Track” (DNT) features that can send a signal to the websites
the User visits indicating the User does not wish to be tracked. Because there is not
yet a common understanding of how to interpret the DNT signal, RF-Works’
Services do not currently respond to browser DNT signals. The User can use the
range of other tools RF-Works provide to control data collection and use, including
the ability to opt out of receiving marketing from RF-Works as described above.

SECTION 7.3.6.8 – Data portability: Data portability is the ability to obtain some
of the User’s information in a format the User can move from one service provider
to another (for instance, when the User transfers mobile phone number to another
carrier).  Depending on the context, this applies to some of the User’s information,
but not to all of the User’s information.  Should the User request it, RF-Works will
provide the User with an electronic file of the User’s basic account information and
the information the User creates under the User’s sole control.

SECTION 7.3.7 – INTERNATIONAL TRANSFER OF INFORMATION
RF-Works collect information globally and primarily store that information in the
United States, United Kingdom and Germany. RF-Works transfer, process and
store the User’s information outside of the User’s country of residence, to wherever
RF-Works or RF-Works’ third-party service providers operate for the purpose of
providing the User the Some of RF-Works’ Products or Services purchased.
Whenever RF-Works transfer the User’s information, RF-Works take steps to protect
it.

Some of the third parties described in this privacy policy, which provide services to
RF-Works under contract, are based in other countries that may not have
equivalent privacy and data protection laws to the country in which the User reside.
RF-Works are subject to the investigatory and enforcement powers of the U.S.
Federal Trade Commission (FTC).

SECTION 7.3.8 – Contact Us

The User’s information is controlled by RF-Works Inc.  If the User has questions or
concerns about how the User’s information is handled, please direct that inquiry to
RF-Works, which RF-Works has appointed to be responsible for facilitating such
inquiries or, if the User is a resident of the European Economic Area, please contact
RF-Works’ representative at Privacy@RF-Works.com.

SECTION 8 – RIGHTS

SECTION 8.1 – CONFIRMATION

The User has the right to confirmation as to whether or not RF-Works process
personal data and, where RF-Works do, access to the personal data, together with
certain additional information. That additional information includes details of the
purposes of the processing, the categories of personal data concerned and the
recipients of the personal data. Providing the rights and freedoms of others are not
affected, RF-Works will supply to the User a copy of the User’s personal data. The
first copy will be provided free of charge, but additional copies may be subject to a
reasonable fee.

SECTION 8.2 – ACCURACY OF DATA

The User has the right to have any inaccurate personal data about the User rectified
and, taking into account the purposes of the processing, to have any incomplete
personal data about the User completed.

SECTION 8.3 – ERASURE

In some circumstances the User has the right to the erasure of the User’s personal
data without undue delay. Those circumstances may include: the personal data are
no longer necessary in relation to the purposes for which they were collected or
otherwise processed; the User withdraws consent to consent-based processing; the
User objects to the processing under certain rules of applicable data protection law;
the processing is for direct marketing purposes; and the personal data have been
unlawfully processed. However, there are exclusions of the right to erasure. The
general exclusions include where processing is necessary: for exercising the right of

freedom of expression and information; for compliance with a legal obligation; or
for the establishment, exercise or defense of legal claims.

SECTION 8.4 – RESTRICTION OF PROCESSING

In some circumstances the User has the right to restrict the processing of the
User’s personal data. Those circumstances are: the User contests the accuracy of
the personal data; processing is unlawful but the User opposes erasure; RF-Works
no longer need the personal data for the purposes of RF-Works’ processing, but the
User requires personal data for the establishment, exercise or defense of legal
claims; and the User has objected to processing, pending the verification of that
objection. Where processing has been restricted on this basis, RF-Works may
continue to store the User’s personal data. However, RF-Works will only otherwise
process it: with the User’s consent; for the establishment, exercise or defense of
legal claims; for the protection of the rights of another natural or legal person; or
for reasons of important public interest.

SECTION 8.5 – OBJECTION TO PROCESSING

The User has the right to object to RF-Works’ processing of the User’s personal data
on grounds relating to the User’s particular situation, but only to the extent that the
legal basis for the processing is that the processing is necessary for: the
performance of a task carried out in the public interest or in the exercise of any
official authority vested in us; or the purposes of the legitimate interests pursued
by RF-Works or by a third party. If the User makes such an objection, RF-Works will
cease to process the personal information unless RF-Works can demonstrate
compelling legitimate grounds for the processing which override the User’s
interests, rights and freedoms, or the processing is for the establishment, exercise
or defense of legal claims.

SECTION 8.6 – OBJECTION TO MARKETING

The User has the right to object to RF-Works’ processing of the User’s personal data
for direct marketing purposes (including profiling for direct marketing purposes). If

the User makes such an objection, RF-Works will cease to process the User’s
personal data for this purpose.

SECTION 8.7 – OBJECTION TO RESEARCH

The User has the right to object to RF-Works’ processing of the User’s personal data
for scientific or historical research purposes or statistical purposes on grounds
relating to the User’s particular situation, unless the processing is necessary for the
performance of a task carried out for reasons of public interest.

SECTION 8.8 – RIGHT OF RECIEPT

To the extent that the legal basis for RF-Works’ processing of the User’s personal
data is:
(a)    consent; or
(b)    that the processing is necessary for the performance of a contract to which
the User is party or in order to take steps at the User’s request prior to entering
into a contract,
and such processing is carried out by automated means, the User has the
right to receive the User’s personal data from RF-Works in a structured, commonly
used and machine-readable format. However, this right does not apply where it
would adversely affect the rights and freedoms of others.

SECTION 8.9 – INFRINGEMENT OF DATA PROTECTION LAWS

If the User considers that RF-Works’ processing of the User’s personal information
infringes data protection laws, the User has a legal right to lodge a complaint with a
supervisory authority responsible for data protection. The User may do so in the EU
member state of the User’s habitual residence, the User’s place of work, or the
place of the alleged infringement.

SECTION 8.10 – WITHDRAWL OF CONSENT

To the extent that the legal basis for RF-Works’ processing of the User’s personal
information is consent, the User has the right to withdraw that consent at any time.
Withdrawal will not affect the lawfulness of processing before the withdrawal.

SECTION 8.11 – EXERCISE OF RIGHTS

The User may exercise any of the User’s rights in relation to the User’s personal
data by providing written notice to RF-Works at 1221 Worthington Woods Blvd,
Columbus, OH 43085, Privacy@RF-Works.com, or by any other methods specified in
this Section 8.

SECTION 9 – USE OF DATA

SECTION 9.1 – PROVISION OF USER DATA TO THIRD PARTIES

SECTION 9.1.1 – AFFILIATES

RF-Works may disclose the User’s personal data to any member of RF-Works’ group
of companies including RF-Works’ subsidiaries, corporate partners, affiliates,
contractors, and agents insofar as reasonably necessary for the purposes, and on
the legal bases, set out in this policy.

SECTION 9.1.2 – ADVISORS
RF-Works may disclose the User’s personal data to our insurers or professional
advisers insofar as reasonably necessary for the purposes of obtaining or
maintaining insurance coverage, managing risks, obtaining professional advice, or
the establishment, exercise or defense of legal claims, whether in court proceedings
or in an administrative or out-of-court procedure.

SECTION 9.1.3 – FINANCIAL TRANSACTIONS
Financial transactions relating to the Website and Services may be handled by RF-
Works’ payment services providers. RF-Works will share transaction data with RF-
Works’ payment services providers only to the extent necessary for the purposes of
processing payments, refunding such payments and dealing with complaints and
queries relating to such payments and refunds.

SECTION 9.1.4 – THIRD PARTIES
RF-Works may disclose User inquiry data to one or more RF-Works third party
suppliers for the purpose of enabling them to contact the User so that the third

party can offer, market and sell to the User relevant goods or services. Each such
third party will act as a data controller in relation to the data that RF-Works
supplies to it; and upon contacting you, each such third party will supply to the
User a copy of its own privacy policy, which will govern that third party's use of the
User’s personal data as well as the rights and obligations of such third party with
respect to the User.

SECTION 9.1.5 – LEGAL OBLIGATIONS
In addition to the specific disclosures of personal data set out in this Section 9, RF-
Works may disclose the User’s personal data where such disclosure is necessary for
compliance with a legal obligation to which RF-Works are subject, or in order to
protect the User’s vital interests or the vital interests of another natural person. RF-
Works may also disclose the User’s personal data where such disclosure is
necessary for the establishment, exercise or defense of legal claims, whether in
court proceedings or in an administrative or out-of-court procedure.

SECTION 10 – RETENTION AND DELETION OF DATA

SECTION 10.1 – Personal data that RF-Works process for any purpose or purposes
shall not be kept for longer than is necessary for that purpose or those purposes.

SECTION 10.2 – Absent notice by User to RF-Works in conformance with this
Agreement, RF-Works will retain the User’s personal for a minimum period of [two
years] following the last date of the User’s use of the Website, and for a maximum
period of [seven years] following the last date of the User’s use of the Website.

SECTION 10.3 – In some cases it is not possible for RF-Works to specify in
advance the periods for which the User’s personal data will be retained. In such
cases, RF-Works will determine the period of retention based on the period of
retention of personal data will be determined based on commercially and legally
reasonable standards.

SECTION 10.4 –Notwithstanding the other provisions of this Section 10, RF-Works
may retain the User’s personal data where such retention is necessary for
compliance with a legal obligation to which RF-Works are subject, or in order to
protect the User’s vital interests or the vital interests of another natural person.
